Terms and Conditions of Use for the “Pick-up” Platform

Article 1: Identification

The website www.alphapneus.lu is operated by Alpha Pneus s.à r.l., whose registered office is located at 50A rue des Bruyères, 1274 Howald, Grand Duchy of Luxembourg. The company is registered in the Trade and Companies Register under number B-287106 and has VAT number LU35866887. Establishment authorisations nos. 10170459/0 to 3. You can contact Alpha Pneus on +352 265651.

Article 2: Purpose

These Terms and Conditions govern the use of Alpha Pneus’s “Pick-Up” platform. This service allows you to book an appointment for a driver to collect a vehicle from the driver’s business address, in order to take it to our workshop for the fitting of new tyres or tyres in storage. The vehicle is then returned to the same address. This is not an online tyre sales site.

Eligible vehicles are:

• Passenger cars, 4x4s, SUVs

• Light commercial vehicles (<3.5 tonnes)

The service is intended for:

• Vehicles under an operating lease or owned by a company with a credit line with Alpha Pneus

• Individuals or businesses without an open account, subject to payment in advance.

The “Pick-Up” service is primarily intended for:

• Replacement of tyres purchased from Alpha Pneus

• Fitting of tyres held in storage at Alpha Pneus, regardless of their initial condition.

Article 3: Geographical coverage

In principle, the service is available for any collection located within a 15-minute drive of the sales outlet. No vehicle collections are made from home addresses. If the address is too far away, the system will alert the user, but the request may still be submitted for review.

Article 4: Booking procedure

Bookings are made exclusively via the website. The user must create an account by entering their registration number and a password. The information provided must be accurate, particularly the collection address. The vehicle must be available for the entire day of the appointment. Alpha Pneus undertakes to return the vehicle on the same day, without specifying the exact time of return.

Article 5: Choice of date

Upon logging into their account, the user selects a date from those available. A manual confirmation is then sent by Alpha Pneus to validate the information and the availability of the goods. If a problem arises, Alpha Pneus will contact the user to adjust or cancel the request.

Article 6: Choice of tyres

• Leased vehicles: Tyres are changed in agreement with the leasing company.

• Company vehicles with an open account: A signed order must be provided before the appointment is confirmed.

• Private individuals and businesses without an account: A quote will be sent, with a link to make the payment online.

Article 7: Prices and payment

Prices are negotiated annually for leasing contracts. For customers, a personalised quote is sent on request. Payment is made by credit card, and final confirmation is sent upon receipt of payment.

Article 8: Invoicing

The invoice is issued after the service has been provided, based on the known details (mileage, tyre condition, etc.).

Article 9: Right of withdrawal / cancellation

The user may cancel a request free of charge at any time prior to receiving confirmation. Once this confirmation has been sent, the user may no longer modify the request themselves. For any changes, they must contact Alpha Pneus by email at info@alphapneus.lu or by telephone on +352 265 651.

An appointment may be rescheduled free of charge provided this request is made at least 48 working hours before the scheduled date. In the event of a definitive cancellation, a fixed compensation fee of €50 (excluding VAT) will be charged to cover administrative costs and bank charges.

Once the vehicle has been collected by the driver, the right of withdrawal regarding the service no longer applies. However, the user may still cancel the fitting service or the purchase of new tyres if these have not yet been fitted. The cost of the collection service remains the responsibility of the user once the vehicle has been collected.

If the vehicle does not have its anti-theft wheel nut, it will be returned without the tyres being changed, and the collection fee will be payable. Due to the nature of the new products sold, the user cannot exercise their right of withdrawal once the tyres have been fitted to the vehicle.

If the goods ordered cannot be delivered within 30 days, the user may cancel their order and the collection service free of charge, although Alpha Pneus is not responsible for manufacturers’ production and delivery times.

Article 10: Refund Policy

In the event of cancellation, a refund will be issued no later than 30 days from the date originally scheduled for the appointment.

Article 11: Refusal of service

Alpha Pneus reserves the right to refuse a collection request if incorrect or missing information jeopardises the smooth running of the service. If the address provided is incorrect or private, or if circumstances beyond Alpha Pneus’s control make it impossible to fit the vehicle, the collection may be cancelled.

Furthermore, in the absence of a vehicle compliance certificate or in the event of doubt regarding the approval of the equipment, Alpha Pneus may refuse to carry out the services, for safety reasons. The vehicle must be in a reasonably clean condition.

Alpha Pneus also reserves the right to refuse access to the pick-up service in the event of misuse by a user.

Article 12: Force majeure

Alpha Pneus may postpone the provision of a pick-up service due to weather conditions compromising road safety or legal requirements, particularly if summer tyres are fitted. Alpha Pneus may also postpone the appointment in the event of circumstances beyond its control (strikes, roadblocks, accidents, bad weather, breakdowns, etc.).

In the event of a foreseeable delay preventing the vehicle from being returned before 6pm, a postponement will be proposed in agreement with the user. Furthermore, if the driver finds that the vehicle’s tyres are unserviceable (tread depth at 1.6mm), they are entitled to refuse to drive the vehicle.

Article 13: Complaints

Complaints must be submitted within 24 hours of returning the vehicle. No claim for damage will be accepted without time-stamped photographic evidence taken from all angles of the vehicle, including a close-up of the wheels and a photo of the odometer, all taken within 24 hours prior to the appointment.

Alpha Pneus is the sole judge of the condition of the tyres. If tyres are deemed beyond repair (summer tyres at 2.5 mm, winter tyres at 4 mm), they will be discarded. The driver may claim the tyres within 24 hours of the service; after this period, their availability cannot be guaranteed.

The driver is also advised to remove any valuables from their vehicle prior to collection.

Article 14: Data Protection

Personal data is used solely for the proper performance of the service and is neither sold nor disclosed to third parties. The customer may access their data by logging into their account or by contacting Alpha Pneus via email or post.

Article 15: Disputes

In the event of a dispute, the courts of Luxembourg shall have exclusive jurisdiction, and only the French versions of the Terms of Use and Terms and Conditions shall be deemed authentic.
